TERMS OF SERVICE

Welcome to the Houston Education Foundation’s Website ("we," "us," “Ministry,” or "our"). The Houston Education Foundation, Inc. is a Texas religious non-profit corporation. The Ministry website (https://www.hfound.org/) (the “Site”) is comprised of various web pages operated by the Ministry. The Site is offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained herein (the “Terms”). 

The purpose of this website is to provide information regarding the Ministry, including contact information, eligibility and application requirements, and online application forms and related materials.

1. Acceptance of Terms. By accessing or using this Site, you agree to these Terms of Service and all applicable laws. If you do not agree, you must not use the Site. Continued use after updates to the Terms constitutes acceptance of those changes. It is your responsibility to review the Terms periodically.

2. Privacy. Your use of the Site is subject to the websites Privacy Policy, please review the Privacy Policy which also governs the Site and informs users of data collection practices.

3. Electronic Communications. Visiting the Site or emailing the Site means you agree to receive electronic communications. You agree that all notices, agreements, disclosures, and other communications provided electronically (including by email or on the Site) satisfy any legal requirement that they be in writing.

4. Your Security. If you use this Site, you are responsible for maintaining the confidentiality of any account information, including your username and password, and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account. You may not transfer or assign your account to any other person. If you communicate with us via email or provide information through email, you are responsible for ensuring the accuracy of that information and for maintaining the security of your email account. You acknowledge that email communications may not be secure, and you agree that the Site is not responsible for unauthorized access, interception, or misuse of information transmitted via email. The Site is not liable for any loss or damage arising from your failure to safeguard your account or email communications. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

5. Links to Third Party Sites/Third Party Services. The Site may include links to third-party websites, including an application website (“Linked Sites”). These Linked Sites are not under our control, and we are not responsible for their content, availability, or any updates or changes made to them. The inclusion of such links is provided solely for convenience and does not imply endorsement, sponsorship, or affiliation with the third party. Any information you submit through the application or other third-party services is subject to the terms and privacy policies of those third parties. By choosing to access or use these services, you acknowledge and agree that the Site may share relevant information as necessary to facilitate the requested service, and that we are not responsible for how third parties collect, use, or manage your data.

6. No Unlawful or Prohibited Use/Intellectual Property. You are granted a non-exclusive, non-transferable, revocable license to access and use the Ministry’s Site in accordance with these Terms. You agree not to use the Site for any unlawful or prohibited purpose, or in any way that could damage, disable, overburden, or impair the Site or interfere with others’ use. You may not attempt to obtain any materials or information through means not intentionally provided by the Site. All content on the Site, including text, graphics, logos, images, and software, is the property of the Ministry or its suppliers and is protected by applicable intellectual property laws. You agree to comply with all proprietary notices and not to modify or remove them.
   
   You may not modify, reproduce, distribute, transmit, reverse engineer, create derivative works from, or otherwise exploit any Site content, in whole or in part. Content is provided for personal use only and may not be resold or used without prior written permission from the Ministry and, where applicable, the copyright owner. Your use of the Site does not grant you any ownership rights or licenses to the Ministry’s intellectual property except as expressly stated in these Terms.

7. International Users. The Site is controlled and operated by the Owner from offices in the United States. If you access the Site from outside the United States, you are responsible for complying with all applicable local laws and regulations. You agree not to use the Site or its content in any manner that violates such laws.

8. INDEMNIFICATION. You agree to INDEMNIFY, DEFEND AND HOLD HARMLESS THE MINISTRY, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site, your violation of any terms of this Agreement, or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. The Ministry reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with the Ministry in asserting any available defenses.

9. Class Action Waiver. Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and the Ministry agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10. LIABILITY DISCLAIMER. 

    1. THE INFORMATION AND SERVICES AVAILABLE THROUGH THE SITE, INCLUDING ANY LOAN ELIGIBILITY APPLICATIONS, MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES MAY BE MADE TO THE CONTENT AT ANY TIME WITHOUT NOTICE. THE MINISTRY AND/OR ITS SUPPLIERS MAY UPDATE OR MODIFY THE SITE AT THEIR DISCRETION.

    2. THE MINISTRY MAKES NO REPRESENTATIONS REGARDING THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF ANY INFORMATION OR SERVICES PROVIDED THROUGH THE SITE. ANY RESULTS OR OUTPUT FROM A LOAN ELIGIBILITY APPLICATION ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE A GUARANTEE OF APPROVAL OR AN OFFER. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, AND ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE DISCLAIMED.

    3. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MINISTRY SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY APPLICATION OR QUESTIONNAIRE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    4. IF YOU ARE DISSATISFIED WITH THE SITE OR THESE TERMS, YOUR SOLE REMEDY IS TO DISCONTINUE USE OF THE SITE. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU

11. Termination/Access Restriction. The Ministry may terminate your access to the Site or related services at any time without notice. These Terms are governed by the laws of the State of Texas, and you agree that any disputes will be handled exclusively in Texas courts. The Site is not intended for use in any jurisdiction where these Terms would not be enforceable. Nothing in this agreement creates a joint venture, partnership, employment, or agency relationship between you and the Ministry. The Ministry’s obligations remain subject to applicable laws and legal processes, including compliance with governmental, court, or law enforcement requests regarding your use of the Site. If any provision of these Terms is found invalid or unenforceable, it will be replaced with a valid provision that most closely reflects the original intent, and the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and the Ministry regarding the Site and supersede all prior communications, whether electronic, oral, or written. A printed version of these Terms and related electronic notices is admissible in legal proceedings. This agreement and all related documents are written in English.
